In 2022, Chechen bailiffs transferred over 8 million rubles to the state budget in enforcement proceedings to recover fines imposed by courts as punishment for committing crimes.
Basically, these are criminal fines imposed on citizens convicted of theft, fraud, as well as fictitious registration of foreigners.
The amount recovered for 1 million 379 thousand rubles. exceeds the total amount of fines for the same period in 2021.
Let us remind you that the procedure for executing a penalty in the form of a fine imposed for committing a crime is set out in Art. 103 of the Federal Law «On Enforcement Proceedings». According to the established standards, the convicted person is obliged to pay the fine within 60 days from the date of entry into force of the judgment.
Among the prerequisites for discontinuing enforcement proceedings to collect a fine for a crime provided for by law, there is no impossibility of collecting the fine due to the lack of property or income of the debtor, and the return of the enforcement title without execution is not provided for.
Failure to pay the fine within the prescribed period in accordance with Art. Part One of Article 32 of the Executive Criminal Code of the Russian Federation constitutes malicious evasion of fines and entails the substitution of a fine for another type of punishment. This reinforces the principle of the inevitability of criminal punishment.
