В ЧР судебные приставы взыскали более 57 млн руб с должников

In 2022, Chechen bailiffs collected over 57 million rubles in execution fees from debtors who did not pay their debts on time. This is 15 million rubles more than in the same period of 2021. This was reported by the press service of the UFSSP of Russia for the Chechen Republic.

According to the Federal Law «On Enforcement Proceedings», the enforcement fee is a monetary penalty imposed on the debtor if, without good reason, he fails to comply with the requirements of the executive document within the period established by law.

The deadline for voluntary fulfillment of the requirements of the enforcement title is up to 5 days from the date of notifying the debtor of the initiation of enforcement proceedings. If the debtor has not taken action within the prescribed period to comply with the requirements of the enforcement title or has not provided the bailiff-enforcement officer with evidence that enforcement was impossible due to force majeure circumstances, the bailiff issues an order to collect the enforcement fee.

The performance fee is set at 7% of the amount to be recovered or the value of the property to be recovered. However, the amount of the fee is not less than 1000 rubles. from a debtor-citizen or individual entrepreneur and not less than 10,000 rubles. — from the debtor’s organization.

In case of non-execution of a non-property executive document, the execution fee from the debtor-citizen or debtor-individual entrepreneur is 5,000 rubles, from the debtor’s organization — 50,000 rubles.
