HeadHunter’s lawyer, labor law expert Tatiana Nechaeva told Russians that in May the work was paid on public holidays. According to her, employees who work on weekends and public holidays are entitled to at least double the pay for the hours actually worked or a full day off.
Russians working a five-day week will rest from April 30 to May 3, and then from May 7 to May 10. Those who work in the six-day working week rest from May 1 to May 2 and from May 8 to 10. The lawyer noted that shift workers will rest on workdays just like everyone else, but their days off are set on a schedule.
«The commitment of employees to work on weekends and holidays must be paid at least twice the amount for the hours actually worked on that day, or another day of rest is provided (a full day of rest, even if the person has worked five hours),» Nechaeva told RIA Novosti journalists.
The expert emphasized that it is possible to engage an employee to work on weekends and non-working days with written consent, if it is required to perform unforeseen work in advance, on which the normal functioning of the organization or its departments depends.
Involvement without consent is possible in the most extreme case of a disaster, accident or accident. Their list is in the Labor Code, said Nechaeva. She also added that some jobs that require constant presence at the workplace are related to separate rules.
The features of the attractions on weekends and bank holidays may also be specified in the collective agreement. In some cases, where there is a trade union, employee holiday involvement will need to be coordinated with it. It is forbidden to engage pregnant women and people under the age of 18 to work on weekends and holidays.
