Эксперт РАНХиГС прокомментировала поправки к Закону о госслужбе

The amendments to the Civil Service Act will come into force on April 29, 2023. The RANEPA expert believes that the amendments to the Civil Service Act will positively affect the attestation procedure.

An expert of the North Caucasian Institute, a branch of RANEPA, candidate of political science Aza Mankiyeva noted that now such exams are held for many temporary workers.

The personnel departments of state authorities will be required to check whether the employee or candidate for the position meets the qualification requirements. We are talking about situations where such authority is not exercised by someone else (in particular, the competition or attestation committee). Personnel officers will assess the professional level. They will apply to the unit in which the position in the assessment is determined. It will also be possible to involve scientific, educational and other competent organizations.

The Civil Service Act will specify that the professional level is the level of knowledge and skills needed to perform official duties. This term will replace the notion of ‘qualification level’. It will also define what should be understood as the area and type of profession.

Employers will be able to impose requirements on job candidates regarding qualifications obtained under the vocational retraining programme.

“This provision simplifies the work of state authorities, since there have been misunderstandings in judicial practice regarding the passage of the certification commission. Examples include: the attestation commission was established in violation (the employer did not meet the requirement of the Civil Service Act: he included independent experts in the commission, the number of which was less than 1/4 of the total number of members. ; did not receive the employee’s consent for the extraordinary certificate (the employer included a condition in the contract with the employee: on the basis of the results of the annual report on professional achievements, an extraordinary certificate can be issued. Based on its results, the employee was dismissed). Therefore, these changes will have a positive impact on the attestation procedure,” said Aza Mankiyeva, SCI RANEPA expert.
